Who Determines Your IR35 Status?

Public Sector or Medium/Large Private-Sector Client

In most cases the client is responsible for determining your employment status for tax purposes. Where applicable, you should receive a Status Determination Statement explaining the decision.

Small Private-Sector Client

Where the end client qualifies as small for the off-payroll rules, responsibility generally remains with your intermediary — typically your personal service company — to determine whether IR35 applies.

Important: IR35 status is not determined simply by the wording of a contract. The contractual terms and the reality of the working relationship both matter. Factors such as control, personal service/substitution and mutuality of obligation may be relevant to an employment-status assessment.

Inside IR35 vs Outside IR35

The tax treatment of a contractor engagement can differ significantly depending on whether the off-payroll working rules apply.
